General Rental Terms and Conditions of: The private limited liability company STREAM MY EVENT, having its registered office at 1101 EZ Amsterdam, at the address Keienbergweg 17, hereinafter referred to as: “SME”.

Article 1: Definitions

  1. Lessor: Stream My Event B.V., established at Keienbergweg 17, 1101 EZ Amsterdam, hereinafter referred to as ‘Lessor’.
  2. Lessee: The natural person or legal entity who has entered into an agreement with the Lessor concerning the rental of, among other things, but not limited to, audiovisual and ICT equipment.
  3. Dry Hire: The rental and use of the Lessor’s property without any personal guidance or support from the Lessor.

Article 2: Applicability

  1. These general rental terms and conditions apply to all rental agreements and related services offered by the Lessor.

Article 3: Offer and Acceptance

  1. All offers and quotations from the Lessor are without obligation until confirmed by the Lessor by e-mail after being signed by the Lessee.
  2. An agreement is concluded at the moment the rental order is confirmed in writing by the Lessor.

Article 4: Dry-Hire Basis

  1. The equipment specified in the contract is always rented on a dry-hire basis, i.e. without service or support, unless explicitly stated otherwise in the contract.

Article 5: Rental Period and Maintenance

  1. The rental period begins at the time of collection or delivery on site and ends at the contractually agreed time of return.
  2. If the return deadline is exceeded, the rental period is automatically extended for the same duration, and these costs will be charged. Only full daily rates apply; partial days are not calculated.
    Example: If the agreed return is Wednesday before 17:00 and the actual return is Friday at 11:00, two additional rental days will be charged.
  3. Rental periods and daily rates are calculated per 24 hours.
  4. Maintenance of the equipment during the rental period remains the responsibility of the Lessor, unless damage results from improper use by the Lessee.

Article 6: Responsibility and Damage

  1. The Lessee is responsible for the equipment from the time of receipt until the time of return.
  2. The Lessee is fully liable for all damage to the rented equipment, including all consequential damages. The Lessor will check the equipment for defects within two working days after return. If defects are found, they will be communicated by e-mail. The resulting costs will also be communicated and invoiced by e-mail within two weeks. The Lessee shall pay these costs within 7 days.
  3. The Lessor has insurance for the equipment during the rental period, subject to an excess of €1000 per incident. Coverage is subject to the following conditions:
    • Theft, loss and/or disappearance during use and/or transport is only covered if due care and caution have been exercised.
    • Theft, loss and/or disappearance during physical presence of the insured is only covered if due care and caution have been exercised.
    • Theft, loss and/or disappearance during physical absence of the insured is only covered in the event of burglary.
    • Theft from a vehicle after leaving it at the end of the working day is excluded, unless the vehicle is in a locked space or at least equipped with an active acoustic alarm system (formerly class 2 Kiwa SCM standards).
    • Theft of insured items as a result of theft of the entire vehicle is covered. After the end of the working day, this coverage only applies if the vehicle is in a locked space or at least equipped with an active acoustic alarm system (formerly class 2 Kiwa SCM standards).
  4. If the insurer does not pay out, the full risk and responsibility for the damage reverts to the Lessee. If the insurer does pay out, the Lessee’s liability is limited to the excess of €1000 per incident.

Article 7: Payment Terms

  1. Invoicing takes place prior to the rental period. Payment must be made before the start of the rental period, unless otherwise agreed in writing.
  2. If the Lessee fails to pay on time, they are automatically in default, and the Lessor has the right to demand full payment and, if necessary, dissolve the agreement. The Lessor is thereby entitled to repossess or withhold the equipment.

Article 8: Cancellation

  1. Cancellation by the Lessee must be notified to the Lessor in writing as soon as possible.
  2. In the event of cancellation, the Lessor will charge costs according to the following policy:
    • Less than 23 hours before the start of the rental period: 100% of the invoice.
    • 24 to 48 hours before the start: 50% of the invoice.
    • 48 to 96 hours before the start: 25% of the invoice.
    • More than 96 hours before the start: 0% of the invoice.

Article 9: Liability

  1. The Lessor is not liable for any damage arising from the use of the equipment by the Lessee.
  2. The Lessee indemnifies the Lessor against all third-party claims related to damage caused by or with the rented equipment.

Article 10: Force Majeure

  1. The Lessor is not obliged to fulfill any obligation if prevented from doing so due to a circumstance that cannot be attributed to fault and is not their responsibility under the law, legal acts, or generally accepted standards.

Article 11: Disputes and Governing Law

  1. All agreements between the Lessor and the Lessee are governed by Dutch law.
  2. All disputes arising from agreements between the Lessor and the Lessee shall be submitted to the competent court in Amsterdam.

Article 12: Final Provisions

  1. If any provision of these general conditions proves to be null or is annulled, the remaining provisions shall remain fully effective, and the Lessor and Lessee shall consult to agree new provisions replacing the invalid or annulled ones, reflecting as closely as possible the purpose and intent of the original provisions.

Article 13: Amendments to the Terms

  1. The Lessor may amend or supplement these general terms and conditions at any time.
  2. Amendments shall take effect upon publication or upon notification to the Lessee, without any compensation being required from the Lessee.
