Article 3 - Payment Conditions

  • For assignments with a total service value below €50,000 (excluding VAT), the payment term is 14 days from the invoice date. Invoices are generally issued on the day of delivery. This 14-day term is the standard payment period for services rendered by SME.
  • For assignments with a total service value above €50,000 (excluding VAT), a 50% advance payment of the total is required. SME will issue an advance invoice prior to delivery. SME is entitled to suspend delivery if the advance invoice is not paid in time. The remaining 50%, plus any additional incurred costs, will be invoiced (generally on the day of delivery) with the standard 14-day payment term.
  • For assignments where an advance payment is required but the Client cannot pay in advance due to urgency, SME retains ownership rights and will withhold delivery of the final products (such as recorded media) until full payment has been made.
  • For assignments where SME provides products in addition to services (such as equipment installations, studio materials, and related items), SME will issue an invoice for the total value of the products plus a 50% advance payment for service costs (e.g., labor). This invoice has a 14-day payment term. Only after receipt of payment will SME execute the order, place product orders with suppliers, and begin preparatory work.
  • For first-time Clients, SME will issue an invoice for 100% of the quoted amount. This invoice must be paid no later than 48 hours before the scheduled service delivery. SME reserves the right to suspend services until payment is received.
  • Clients who use supplier onboarding systems or similar administrative/payment systems that may delay payments must inform SME prior to confirmation of the quotation.
  • If such mandatory systems prevent timely payment in line with these payment terms, SME will charge €35 per day for late payment, calculated from the day the payment term expires until the invoice is paid.
  • Clients who use a purchase order (PO) system must inform SME at the time of quotation confirmation and must provide the PO number by e-mail (both to their SME contact person and in cc to [email protected]) prior to delivery. SME reserves the right to charge €35 per day if failure to provide the PO number prevents timely payment of the invoice in accordance with these payment terms, calculated from 14 days after the delivery date until full payment is received.

Article 4 - Consequences of Default

If the Client fails to pay the amounts due within the invoice payment term, the Client shall be in default without further notice. The outstanding amount will, from the day the term expires, be increased by extrajudicial collection costs and statutory interest at the monthly rate on the invoice amount, until the day full payment is received. Interest for part of a month shall be calculated as a full month.
